July 18, 2023 (United States District Court, Northern District of Illinois): As the Chicago Sun Times headline reads: In conspiracy to commit prostitution, Travel Act and Mann Act offenses, “Federal judge gives probation sentence to woman who ran West Side fetish business.” Sheppard Law Firm’s client received probation after facing an advisory federal sentencing guideline range of 30-37 months and where the government had advocated for a 30-month sentence. June 7, 2023 (Skokie Courthouse, Circuit Court of Cook County): All charges, including Class 1 Possession of a Controlled Substance Charges, Dismissed Following Sheppard Law Firm’s Filing of Motion to Quash Arrest and Suppress Evidence. In People v. XXXXXX, officers approached the defendant, questioned him regarding whether he had a firearm, to which he responded, “yes.” Officers searched him, found the firearm (for which he had a FOID card) and also seized a bag containing suspect cocaine from his person. Sheppard Law Firm’s motion argued that officers did not have a right to search the defendant because, even though he admitted to having a gun on his person, officers failed to first ascertain whether he had a FOID card. In Aguilar, the Illinois Supreme Court held unconstitutional provisions which imposed a blanket ban on an individual’s right to possess a gun for self-defense outside of the home. People v. Aguilar, 2013 IL 112116. Thus, post-Aguilar, even if an officer has a sufficient reason to believe a person possesses a firearm, that is not a basis to arrest him and search his person. Officers must first have probable cause to believe that the person unlawfully possesses the firearm. Following the filling of Sheppard Law Firm’s motion — and presentation of a mitigation packet which included proof of treatment — the State dismissed all charges.

April 13, 2023 (Will County): Golf Course Manager Found Not Guilty of Battering Chief of Police of University Park. Sheppard’s client was found not guilty of all counts — Aggravated Battery to a Peace Officer and Resisting Arrest — following trial where she was accused of battering the chief of police of University Park. December 5, 2017: United States v. (Governor) Rod Blagojevich (U.S. Supreme Court). Adam Sheppard Co-Authors Amicus Brief to U.S. Supreme Court on behalf of the Illinois Association of Criminal Defense Lawyers which is requesting the Court to grant certiorari (hear the case) of United States v. Blagojevich. The IACDL is requesting the Court to consider whether the standard for proving a Hobbs Act violation in a campaign finance case requires an explicit quid pro quo (as the Supreme Court held in McCormick v. United States) or whether a “wink and a nudge” (implicit) standard (developed out of the Court’s decision in Evans v. United States) will suffice. The brief also requests the Supreme Court to review the manner in which a district court must address a defendant’s sentencing arguments about unwarranted sentencing disparities. 2/8/18: The following news article describes the federal court of appeals ruling (7th Circuit) in favor of Sheppards’ client (an airline pilot who was sued based on allegations that he battered his co-pilot). The district court (Northern District of Illinois) dismissed the case against Sheppards’ client based on a lack of diversity of jurisdiction and the appeals court affirmed the dismissal. July 6, 2017: “Probation for Mom Who Dropped Infant to Death from 8th-Floor Window,” Chicago Sun Times.

Sheppard Law Firm’s client, a 19 year-old, was charged with first degree murder based on a charge that she dropped her newborn to death from an 8th-floor window. (See news articles below). Following the submission of an extensive mitigation binder to the State’s Attorney’s Office, the charges were amended to involuntary manslaughter for which she was sentenced to probation with credit for time spent on an electronic monitor to avoid jail time. 50% REDUCTION FROM ADVISORY SENTENCING RANGE BASED ON MENTAL HEALTH OF DEFENDANT IN WELL-PUBLICIZED CASE OF UNITED STATES V. A.N. (U.S. DISTRICT COURT, Northern District of Illinois). In United States v. A.N., on April 9, 2015, in United States District Court, Sheppard Law Firm obtained a 50% reduction from the federal sentencing guideline range in a bank robbery case, described in news articles below, where the defendant was charged with wielding a hammer to effectuate the bank robbery. Sheppard Law Firm engaged a forensic psychiatrist who opined that the defendant was suffering from a substantial diminished capacity at the time of the offense. The government’s expert concurred in the diagnosis of “schizoaffective” disorder but the government requested a much more stringent sentence. The judge granted Sheppard’s request for the more substantial variance from the guideline range. The judge also concurred with Sheppard’s position that the defendant’s criminal history category overstates the seriousness of his criminal history. October, 15 2014: In a case described in the FBI press release below, where the charge against Sheppard’s client typically carries a mandatory minimum of 5 years imprisonment, Sheppard’s client received a sentence of a “year and a day,” meaning that the defendant would serve at most 6-9 months in custody. In UNITED STATES V. D.P., U.S. DISTRICT COURT, NORTHERN DISTRICT OF ILLINOIS, Sheppard’s motion for the rarely granted “mitigating role” adjustment was granted and the judge sentenced Sheppard’s client to a “year and a day,” meaning that Sheppard’s client would serve less than nine months in custody on a case where he was charged with possessing with the intent to deliver over 500 grams of cocaine (That charge which typically carries a five year mandatory minimum). Sheppard had argued that the defendant was acting under the control of his older brother and the judge found sufficient evidence to support that proposition. Accordingly, the judge granted Sheppard’s request for a “mitigating role” adjustment and then departed even further from the advisory guideline range based on the defendant’s history and characteristics. Adam Sheppard Moderates Chicago Bar Association Trial Techniques Seminar Featuring Law School Professors

On December 17, 2013 Adam Sheppard was honored to moderate a trial techniques seminar at the Chicago Bar Association which the Young Lawyers Section of the CBA organized (Adam is an officer of the Young Lawyers Section of the CBA; he serves as member services manager and was the former co-editor-in-chief of the Young Lawyers Journal; he continues to serve on the CBA Record magazine editorial board). The seminar featured two law school professors who spoke on the Illinois Rules of Evidence and the nuts and bolts of a federal criminal case. The seminar had approximately 150 registrants and prominent practitioners were in attendance.
